Basically a Texas man bought a date thinking she was a hooker, and when she tried to leave with his $150, he shot her in the head for not having sex with him. He was acquitted because apparently in Texas you can use lethal force to prevent "theft or mischief", and he simply perceived her to be stealing from him.

I need to leave this state -_-

It doesn't just prove the lunacy of gun laws in Texas, it proves the lunacy of gun culture in the States, period. If guns weren't so damn popular, this wouldn't be happening.

I'm a big proponent of self defense.  I am a gun owner and I shoot often, dare say I take my training pretty seriously since I know I am responsible for every round fired if I have to use my weapon in a self defense situation.

That being said, this guy was an idiot and should have been prosecuted.

Unfortunately, the particulars of this case DO fall within the law.  But, you better believe most gun owners are not cheering for this guy.  They also see him as an idiot, even in Texas.

Can you explain to me how we was "within the law," in this instance.

From the article here: http://www.mysanantonio.com/news/local_news/article/Jury-acquits-escort-shooter-4581027.php

QuoteDuring closing arguments Tuesday, Gilbert's defense team conceded the shooting did occur but said the intent wasn't to kill. Gilbert's actions were justified, they argued, because he was trying to retrieve stolen property: the $150 he paid Frago. It became theft when she refused to have sex with him or give the money back, they said.

Gilbert testified earlier Tuesday that he had found Frago's escort ad on Craigslist and believed sex was included in her $150 fee. But instead, Frago walked around his apartment and after about 20 minutes left, saying she had to give the money to her driver, he said.

That driver, the defense contended, was Frago's pimp and her partner in the theft scheme.

The Texas law that allows people to use deadly force to recover property during a nighttime theft was put in place for "law-abiding" citizens, prosecutors Matt Lovell and Jessica Schulze countered. It's not intended for someone trying to force another person into an illegal act such as prostitution, they argued.

From that it tells me that the defense was able to convince(I can't say prove) the jury that theft was committed after she didn't return the defendant's money after he realized he wasn't getting the services he thought were going to be provided.  Since that was convinced it makes his forceful attempt to get his money back(ie, shooting her), legal under Texas' "Stand your ground" law(actually, I think it's an older law not that one because a different case was tried a few years ago about a guy who used a shotgun to stop two burglars breaking into his neighbor's house, in anycase I'll check and find out to be sure) .

I'm not saying what he did was right, just how it applied in this case.
