So I came across this today.

"Gearbox Software's former lawyer is suing the developer and CEO over a supposed secret $12 million bonus given to Randy Pitchford. Gearbox Software has been at the center of quite a few legal disputes over the last decade, whether it be from falsely advertising Aliens: Colonial Marines or fighting for control of the Duke Nukem IP from 3D Realms. That being said, a brand new lawsuit that was recently ousted by Kotaku and it involves Gearbox CEO Randy Pitchford being sued for taking a supposed $12 million secret bonus."

Those are some serious allegations in there, besides the secret bonus.

Still, I put nothing past anyone, especially Pitchford. If there's anything to find, they'll find it.

A rush to judgment? On the internet? No way.

Without having read the filings yet, and just going on what Jason has reported here, I tend to have trouble believing the child pornography allegation. First, as Gearbox's lawyer, Callendar's duty was to protect Gearbox, not Pitchford. He alleges he had information about child exploitation that could severely damage the company's reputation (and ultimately, sales). He did nothing about it, but instead decided to keep it in his back pocket until it became useful to him?

Second, aside from his obligation to protect the company, what about the moral obligation of reporting a crime against children? Did he not do so because he was not sure that the photos belonged to Pitchford, or because he was protecting his friend? If it's the former, the allegation is probably untrue. If it's the latter, he's at the very least complicit in the abuse of these children.

Now having read the pleadings, it seems to me the allegation is, among other things, aimed at removing the cap on punitive damages. Under Texas law, damages are capped unless you can prove certain things, such as a violation of the Texas Penal Code Section 21.02 (continuous sexual abuse of young child or children).
